HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.3036 of 2016 ORDER:

Vide present petition, petitioner seeks cancellation of the anticipatory bail granted to the 2nd respondent by this court vide order dated 20.08.2013 in Crl.P.No.8424 of 2013.

2. The present petition is filed on the ground that this court vide aforesaid order, directed the petitioner to cooperate with the Investigating Officer and furnish all particulars i.e., required documents etc. for completing the investigation.

Counsel for the petitioner submits that one R.Sunil Kumar, sold out the property i.e., Plot No.391, Northern Part, Sy.No.59/ 2 (Old Sy.No.59-Part), admeasuring 150 sq. yards, in Ward No.8, Block No.7, situated at Teachers Colony, Phase-I, Karmanghat Village, Saroor Nagar Mandal, R.R. District, to LWs.2 and 3 and after coming to know the same, the 2nd respondent in furtherance of her illegal acts and deeds, on 10.12.2012 applied for electricity connection on the above said plot in her name from CPDC of AP, Operation Circle, Ranga Reddy, East Greater Hyderabad, by producing fake and forged gift agreement dated 14.09.2012. Subsequently by using the said fake document, she obtained a temporary electricity connection in her name vide PR No.90612012124 and kept quiet and has been waiting for an opportunity to grab the said plot.

4. Admittedly, the petitioner has failed to produce any documents in support of his contention that the 2nd respondent had taken electricity connection based on any of the fake document.
