THE HON'BLE SRI JUSTICE S.V.BHATT WP.No.18697 of 2018 O R D E R:

The petitioners challenge notice dated 27.5.2018 proposing to survey the agricultural land in Sy.Nos.123 and 138. The petitioners' grievances are manifold including that the survey is not comprehensive, unless and until the boundaries are either identified or accepted, the survey of disputed boundaries cannot be taken up by respondent no.4. The objections are noted not to express a view on the challenge laid to the notice impugned in the writ petition but to give liberty to petitioners to raise all objections. In fact, identity necessitated to comprehensive survey etc., before the 4th respondent or the surveyor who attends for survey operations. This Court has no reason to doubt that the petitioners, if raise objections, the officer undertaking the survey is required to take note of the objections and proceed in accordance with law. The petitioners, if have reason or grievance against the survey, it is always open to them to independently work out their rights before the Court having jurisdiction.

The Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. There shall be no order as to costs. ______________ S.V.BHATT, J Dated: 07/06/2018 Note: C.C. today.
