THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5984 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A1 seeking bail in the event of her arrest in connection with Crime No.896/2021 on the file of Neredmet Police Station, Rachakonda Commissionerate, registered for the offences punishable under Section 306 read with 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. 3.

The case of the prosecution is that the defacto complainant who is the sister of the deceased filed a complaint stating that his deceased brother was married to this petitioner ten years prior, however, this petitioner was indifferent towards the husband and there were differences between them. It is further stated that the petitioner was talking over phone with someone else in the nights for which reason, the deceased frustrated with the attitude of this petitioner, committed suicide.

As seen from the allegations in the complaint and also the suicide note, the grievance of the deceased is that his wife i.e. petitioner herein was talking to other persons over phone and there

are frequent quarrels in his marital life due to the conduct of this petitioner.

As seen from the complaint, even assuming that the petitioner was speaking to someone else and fights in the marital life of the deceased would not amount to offence of abetting suicide, for which reason, this petitioner shall be enlarged on bail in the event of her arrest, subject to the following conditions:

1) The petitioner/A1 is directed to surrender before the Station House Officer, Neredmet Police Station, Rachakonda, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A1 on bail, on her executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/A1 shall appear before the said Station House Officer on every Monday between 10.30 a.m. to 1.00 p.m. for a period of eight weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation.

3) The petitioner/A1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
