ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.5 in Crime No.64 of 2026 before the Veldanda Police Station,
Nagarkurnool District, registered for the offence punishable under Sections 103 read with 3(5) of BNS.

The brief facts of the case are that a complaint lodged by the wife of the deceased alleging longstanding disputes between the deceased's family and the accused over ancestral land, piggery activities, and prior criminal incidents. On 03.04.2026 at about 8:30 PM, while the deceased was returning home, a tipper vehicle allegedly intercepted his car, after which he was dragged out and brutally assaulted with stones, leading to his death. The complainant suspects that the accused, due to prior enmity and fear of the deceased's growing influence, conspired and committed the murder. 3.
Heard Sri B. Bhagath Sain, learned counsel for petitioner, and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioner submitted that the petitioner is innocent and falsely implicated, with no overt act or direct role attributed to him in the alleged offence and that the only allegation against the petitioner is that he introduced another accused (driver), which is vague and insufficient to
establish conspiracy or involvement. The implication is based solely on inadmissible confession statements of co-accused, with no recovery or independent material linking the petitioner to the crime. He contended that the petitioner stands on a different footing from the main accused, has completed custody, and continued detention would amount to pre-trial punishment. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition. 5.
Learned Additional Public Prosecutor opposes the bail, contending that the offence is grave in nature involving a brutal, premeditated murder arising out of prior enmity and that there existed strong motive due to land disputes and earlier incidents, and the accused persons acted in concert pursuant to a conspiracy. The role of the petitioner, though indirect, forms part of the chain of circumstances facilitating the commission of the offence. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 07.04.2026. That apart, the record would show that LWs.1 to
14 are already examined. Further, there is no direct enmity between the petitioner and deceased. Considering the facts and circumstances of the case, and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate, Kalwakurthy.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3)
of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
