THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA ASMP No.1671 of 2017 and APPEAL SUIT No.615 of 2011 JUDGMENT:

The appellant-defendant No.3 is present so also the respondents 3 to 9 are present. Second and third respondents are no more. The learned counsel for the appellant would submit that the legal representatives of the deceased-second and third respondents are already on record and therefore, there is no necessity to file any application, of course a memo to that effect is not filed distinctly showing, which of the parties are the legal representatives of deceased-respondents 2 & 3.

Learned counsel for the appellant, Sri Pottigari Sridhar Reddy is present and Sri N. Venkata Ram Reddy, learned counsel for the first respondent is present. Sri M. Rupender, who is appearing on behalf of respondents 4 to 9 is present. They have identified their respective parties to the present application.

The parties have entered into a memorandum of compromise and terms and conditions have been incorporated therein in clauses 1 to 4. The said memorandum of compromise has been signed by the appellant, respondent No.1 & respondent Nos.4 to 9 and their respective learned counsel.

The parties have been explained the terms mentioned in clauses 1 to 4. They all affirm the said terms and conditions and make a request to record the compromise as per the terms and conditions in the memo.

Since the parties affirm the terms and conditions of the memo of compromise, compromise is recorded so far as it relates to the parties as per the terms incorporated in the Memorandum of Compromise.

Accordingly, the present application is allowed. 7.

In view of the compromise recorded in ASMP No.1671 of 2017 allowing the said petition, the present appeal is disposed of. The memorandum of compromise shall form part of the decree. No costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal, shall stand closed.
