THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5456 of 2017 ORDER:

This Writ Petition is filed challenging the action of the second respondent in highhandedly proceeding with FIR No.11 of 2017 without following due process of law as contemplated under Section 41-A of the Code of Criminal Procedure. Learned Counsel appearing for the petitioners submits that the petitioners apprehend that they would be arrested without following due process of law.

In the circumstances, this Writ Petition is disposed of directing the second respondent to follow due process of law, more particularly Section 41-A of the Code of Criminal Procedure, pursuant to registration of FIR No.11 of 2017 and take necessary further action in accordance with law.
