THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Writ Petition No.21745 of 2019 ORDER :

Heard the counsel for petitioners, the learned Government Pleader for Municipal Administration for 1st respondent, and Sri Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation (G.H.M.C.), for respondent nos.2 to 5.

The grievance of petitioners in this Writ Petition is that petitioners questioned the show-cause notice dt.02.07.2019 issued by the 4th respondent under Sections 452(1) and 461(1) of the Greater Hyderabad Municipal Corporation Act, 1955.

Admittedly, the petitioners have given explanation to the said notice on 04.09.2019.

The petitioners further contended that even before a final order is passed under Section 452(1) of the said Act and communicated to petitioners by respondents, the respondents may demolish the structures erected by petitioners.

Sri Sampath Prabhakar Reddy, counsel appearing for respondent nos.2 to 5, assures that no such demolition will be conducted without communicating the order under Section 452(1) of the said Act and without serving a notice under Section 636 of the said Act to the petitioners.

The said assurance is placed on record.

Accordingly, the Writ Petition is disposed of directing the respondents not to demolish the structures erected by petitioners without passing and communicating to petitioners order under Section 452(2) of the Act and without service of notice under Section 636 of the Act. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
