THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16131 OF 2017 O R D E R :

This Writ Petition has been filed questioning the Order dated 27.03.2017 passed by the 3rd respondent Deputy Commissioner, by which the building permission granted in favour of the petitioner has been cancelled.

The principal ground on which the Writ Petition is filed is that the respondents have not served on the petitioner the show cause notice dated 09.03.2017 which has been referred to in the impugned Order dated 27.03.2017.

When the matter is taken up for hearing, learned Standing Counsel for the respondent Corporation fairly submits that the notice dated 09.03.2017 has not been served on the petitioner and on that ground, the impugned Order may be set aside, however, giving liberty to the respondent Corporation to make a fresh Order by following the due process of law. The submission of the learned Standing Counsel is appreciated.

In that view of the matter, the Writ Petition is allowed by setting aide the impugned Order dated 27.03.2017, giving liberty to the respondent authorities, if they so desire, to take necessary steps in accordance with law. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
