THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18826 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred seeking to declare the action of the respondents in not considering the request of the petitioner for extending the benefits under T-PRIDE scheme as enunciated under GO Ms.No.29, dated 29.11.2014, by the 1st respondent being a women entrepreneur even after lapse of more than one and half year from the date of submission of application on 02.12.2015 through Mee-seva, as illegal and arbitrary and consequently, direct the respondents to extend the incentives under T-PRIDE Scheme to the petitioner forthwith.

Heard and perused the material available on record. The case of the petitioner is that she started travel business by purchasing three Innova and one Fortuner vehicles by obtaining loan from the Bank. Thereafter, she made an application on 02.12.2014 through Mee-seva under T-PRIDE scheme, through which the State Government is extending incentives to the Dalit Community women, seeking release of subsidy amount under the said scheme. But, the respondents are not considering the application made by petitioner and not releasing the amount under the said scheme to the petitioner. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents for consideration of the application made by the petitioner at an early date.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

The Writ Petition is disposed of directing the respondents to consider the application submitted by the petitioner on 02.12.2015 through Mee-Seva and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ______________ RAJA ELANGO, J June 19, 2017 KTL
