THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.1513 of 2010 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus directing respondent Nos.1 to 5 not to permit respondent No.6 from erecting/install land based cell towers in the property situated in Sy.No.591/2 of Chennuru Village, Pedana Mandal, Krishna District. By an order, dated 01.02.2010, this Court directed the respondents not to erect/install any land based cell tower in the property situated in Sy.No.591/2 of Chennuru Village. Subsequently the said stay was vacated on 24.11.2011. At the time when the matter is taken up for hearing, Sri V.S.R. Anjaneyulu, learned counsel for the petitioners submitted that the cell tower has been erected at a different place since the land where the cell tower is intended to be erected is in dispute. In view of the above, he submits that the cause in the writ petition does not survive.

Recording the said submission, this Court is of the view that no further orders are necessary in this writ petition. Accordingly, the Writ Petition is closed. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand dismissed.
