THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11772 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ, or Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in not considering the petitioners case for service regularization and pay fixation of revised pay scales of 2014 and consideration for promotion as a Junior Assistant, as illegal, unsustainable, arbitrary and contrary to the procedure and also violation of Andhra Pradesh State Electricity Board employees Discipline & Appeals Regulations 11(b) as adapted by APTRANSCO and later by APSPDCL, and Article 14, 19 and 21 of the Constitution of India and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice."

2. Heard Sri Dasari S.V.V.S.V.Prasad, learned counsel, appearing for the petitioner, learned Government Pleader for Energy, appearing for the 1st respondent and Smt.J.Koteswari Devi, learned standing counsel, appearing for the respondents 2 to 4.

When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 14.09.2015 to the 4th respondent herein and no orders have been passed on the said representation so far and a copy of the same is also placed on record along with the writ petition as material paper. It is further requested by the learned counsel that necessary direction may be issued to the 4th respondent to pass appropriate orders on the

said representation, in accordance with law, by fixing some timeframe.

Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 4th respondent herein to consider and pass appropriate orders on the representation dated 14.09.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 19.04.2016 SS
