THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.18721 of 2018 ORDER:

Heard Mr.A.M.Qureshi for petitioner and Mr.Arifulla for respondent No.2.

The petitioner apprehending dispossession of petitioner from the property in Sy.No.850 also in Sy.No.850/3 at Atmakur Town, SPSR Nellore District or demolition of structures therein, filed the writ petition. On 07.06.018, at request of Mr.Arifulla, the writ petition is directed to be listed today for counter. The counter affidavit of 2nd respondent is filed. Mr.Qureshi, having regard to the stand of 2nd respondent in paragraph No.8 requests the Court, to place the stand taken in the counter affidavit on record and leave open the remedies available, in the event of order being passed under the Wakf Act, 1995 by the District Collector.

The operative portion of the stand taken in paragraph 8 vis-à-vis Sy.No.850 reads thus:

"That in respect of Sy.No.850 by following due process of law Notices have been issued to the Petitioner and after perusing the same the

explanation of the Petitioner this respondent passed the orders on 19-5-2017 and the order is pending with the District Collector."

The District Collector is directed to pass orders as expeditiously as possible preferably within six (06) weeks from the date of receipt of copy of this order. The Wakf Board is given liberty to file copy of this order along with a memo and seek orders expeditiously. Writ petition is accordingly disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
