THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21800 of 2019 ORDER:

In this writ petition, petitioner challenges provisional order dated 06.08.2019 passed under Section 228(2) of the Municipalities Act, 1965, by the second respondent - Turkayamjal Municipality, Office of the Municipal Council, Turkayamjal, Ranga Reddy District.

It is the allegation of the petitioner that she has not been served with any provisional order dated 27.07.2019 passed under Section 228(1) of the aforesaid Act, as referred to in the impugned order.

Learned counsel for the petitioner fairly submits that explanation is being submitted by the petitioner today. In those circumstances, before proceeding to take action in the matter, the second respondent is directed to consider the explanation that may be submitted by the petitioner and take a decision in accordance with law and communicate the same to the petitioner. This entire exercise shall be completed within a period of fifteen (15) days from today. However, till then, no

CKR, J W.P.No.21800 of 2019 coercive action shall be taken by the second respondent against the petitioner with respect to the subject property. This Writ Petition is accordingly disposed of. Miscellaneous applications, if any pending, shall also stand disposed of.
