HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 7555 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 4 to 6 in trying to dispossess the petitioners without following the due procedure, as illegal and arbitrary and for a consequential direction to the respondents 4 to 6 not to interfere with the peaceful possession and enjoyment of the land in Survey No.150/1, an extent of Ac.5.00 cents, situated at Uppalapadu Village of Nuzendla Mandal, Narasaraopet Revenue Division, Guntur District.

The 4th respondent filed counter except making allegations that petitioners sold away the property. But nothing is stated whether any action is being initiated for violation of the patta conditions against the petitioners. It is also alleged that the petitioners are not in possession of the subject property and the same is disputed by the learned counsel for the petitioners stating that the petitioners are having valid pattadar pass books.

In the instant case granting of patta to the petitioners is admitted, but, in the counter though it is alleged that the petitioners alienated the subject property to the third parties violating the patta conditions, it is silent about initiation of proceedings against the petitioners for violation of patta

conditions. In view of the same, there shall be stay of dispossession of petitioners regarding subject property. However, this will not preclude the authorities from taking action against the petitioner by following due process of law. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, shall stand closed.
