ORDER

This criminal petition under Section 482 Cr.P.C. is filed by the petitioner/complainant to expedite the trial and hearing of C.C.No.267 of 2015 on the file of Junior Civil Judge, Piduguralla, Guntur District, registered for the offences punishable under Sections 138 and 142 of Negotiable Instruments Act, 1881.

Heard learned counsel appearing for the petitioner/complainant and learned Additional Public Prosecutor, representing the State.

Petitioner, who is the complainant, states that the second respondent/accused obtained an order dated 06.04.2016 in Crl.P.No.4756 of 2016 dispensing with its presence before the trial Court except on the dates whenever the learned Magistrate insists for its appearance and it shall be represented by its counsel before the trial Court. The grievance of the petitioner is that even though there was a specific direction to proceed with the trial without appearance of the accused except on specified dates, the learned Magistrate is adjourning the matter for the reason that the accused is not present. Hence, he filed the present petition.

4. Considering the facts and circumstances of the case and in view of the nature of offence, I deem it appropriate to dispose of the criminal petition with the following directions:

The trial Court is directed to dispose of C.C.No.267 of 2016 on the file of Junior Civil Judge, Piduguralla, Guntur District, as expeditiously as possible, within a period of six months from the date of receipt of a copy of this order without seeking any further time for its disposal.

5. The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence. ___________________ M.S.K. JAISWAL, J 20th September, 2016 sj
