This is an Application under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act'). 2.

I have heard the learned counsel for the applicants and the learned counsel for the respondent.

The learned counsel for the respondent submits that the issue is now covered by the proceedings before the National Company Law Tribunal, Hyderabad Bench, Hyderabad, vide C.P.

(IB) No.97/7/HDB/2018, dated 09.07.2018 and that 'Interim Resolution Professional' has been appointed, at the instance of the financial creditor.

Under such circumstances, this Application is closed without prejudice to the applicant seeking appointment of arbitrator under Section 11(6) of the A&C Act as and when it may become necessary on conclusion of the NCLT proceedings.
