This criminal petition is filed for quash of the proceedings in Cr.No.139 of 2011, against the petitioners, who are A1 and A2, on the file of the Station House Officer, Kothapeta Police Station, East Godavari District. The offences alleged are under Sections 447, 341, 323, 506 read with Section 34 of the Indian Penal Code. 2.

Heard the counsel for the petitioners and the learned Public Prosecutor, appearing for the respondent. None appeared for the second respondent in spite of notice.

Both the counsel submit that in spite of the fact that there was stay granted by this Court on 09.11.2011, investigation was conducted and charge sheet was filed on 15.11.2011 and hence, the matter has become infructuous.

In the light of the above, the criminal petition is dismissed. However, petitioners are given liberty to file appropriate petition, if they chose to. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
