THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22554 of 2019 ORDER:

In this Writ Petition, petitioners claim that their lands were acquired by the Government for the purpose of Erragunta Reservoir Project; that Erragunta Reservoir is spread over 2000 acres and that they are Project Affected Persons belonging to Abbapur Village, Navipet Mandal, Nizamabad District, as such, their cases for grant of fishing rights are to be considered in terms of G.O.Ms.No.74, Irrigation & CAD (LA.R&R/A2) Department, dated 14.08.2018.

Learned counsel for the petitioners submits that while dealing with an identical issue in Writ Petition No.17580 of 2017, this Court having found that there is a licensing system introduced by the Government as regards harvesting of fish wealth in the reservoirs and thereby, guidelines are framed, by taking into consideration G.O.Ms.No.74 dated 14.08.2018 as well as G.O.Ms.No.6, Animal Husbandry, Dairy Development & Fisheries (V&F) Department, dated 24.03.2016, and in view of the fact that Ryalampadu Reservoir is spread over 1161 hectares (approximately 2868 acres), disposed of the said Writ Petition along with Writ Petition No.4378 of 2019 vide common order

CKR, J W.P.No.22554 of 2019 dated 24.04.2019 by issuing directions to the authorities therein to consider the cases of the petitioners therein. He also submits that the petitioners herein submitted a representation on 24.07.2019 to the fourth respondent - Assistant Director of Fishermen/Ex-Officio, Deputy Registrar of Fishermen Cooperative Societies, Nizamabad, for grant of fishing rights in Erragunta Reservoir in terms of G.O.Ms.No.74 dated 14.08.2018. In those circumstances, this Writ Petition is disposed of with the direction to the respondent authorities to consider the petitioners' representation dated 24.07.2019 and pass necessary orders subject to payment of requisite charges as may be determined, within four (4) weeks from the date of receipt of a copy of this order.

Miscellaneous applications, if any pending, shall also stand closed.
