ORDER
Pursuant to the notification issued under Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'), the petitioner filed his objections on 9.10.2015. Petitioner filed the present writ petition seeking a direction to the respondents to consider his objections before passing the Award.
It is represented by the learned counsel for the petitioner as well as the learned Government Pleader that as on date, no Award has been passed.
Learned Government Pleader submits that so far as the objections of the petitioner with regard to suitability of the land for the purpose for which the same was acquired is concerned, the same were overruled on 9.11.2015 itself. Insofar as the objection in relation to valuation is concerned, it may be noted that such objections can be filed after the notification is issued under Section 21 of the Act. It is not known as to whether notification under Section 21 of the Act has been issued or not.
Considering the fact that no Award has been passed so far, the objections filed by the petitioner on 9.10.2015 shall also
be considered by the respondent authorities along with other objections, which the petitioner may choose to file with regard to valuation, in terms of Section 21 of the Act. Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
