though the unofficial respondents have been making the above unauthorized construction without any permission and by encroaching upon the public road, as illegal, unlaMul and contrary to law and consequently direct the 2nd respondent Municipality to stop the illegal construction of the unofficial respondents on the above public road by duly taking into consideration of the complaint of the petitioner dated 2010612026 and also taking into consideration of the interim orders of the Hon'ble High Court passed in WP No. 311312021, dated 10-02-2021 and remove the unauthorized construction as made on the public road. l.A.

Respondents ORDER: (ORAL) Heard Mr. M. Damodar Reddy, learned counsel for the petitioner, and Mr. Putta Krishna Reddy, learned standing counsel for respondent No.2.

According to learned counsel for the petitioner, respondent Nos.3 to 6 do not have any building permission, despite the same they are proceeding with the construction on the eastern side of the property bearing H.Nos.16-97, 16-9lll and 16-32 on the back side
of Union Bank of India, Kothakota Town and Mandal, Wanaparthy District, by encroaching public road.

Learned standing counsel for respondent No.2 submitted that representation dated 20.06.2026 submitted by the petitioner for stopping unauthorized construction made by unofficial respondents will be duly considered and orders will be passed in accordance with law.

In view of the aforesaid submission of learned standing counsel for respondent No.2, without entering into the merits of the case, the writ petition is disposed of, directing respondent No.2 to act upon complaint dated 20.06.2026 seeking removal of unauthorized construction made by respondent Nos.3 to 6 on the eastem side of the property bearing H.Nos.16-97, 16-9lll and 16-32 on the back side of Union Bank of India, Kothakota Town and Mandal, Wanaparthy District, by encroaching public road, and pass orders, in accordance with law, by issuing notice to the petitioner, respondent Nos.3 to 6, and all other concemed/interested persons, by affording opportunity of hearing
to them, within a period of four (4) weeks from the date of receipt of a copy of this order. Further, respondent No.2 is directed to forthwith stop unauthorized construction if any made by respondent Nos.3 to 6 without any sanctioned plan. 5.
As this order is passed without entering into merits, notice to respondent Nos.3 to 6 is dispensed with. If respondent Nos.3 to 6 are in any way aggrieved by this order, they are at liberty to approach this Court seeking modification of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
