THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.6292 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by petitioners/A1 and A3 seeking to quash the proceedings in C.C.No.518 of 2019 on the file of the XXII Additional Metropolitan Magistrate, Cyberabad at Medchal, registered for the offence under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, against them.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor representing the 2nd respondent-State and perused the record.

Though the petitioners have raised several grounds to quash the proceedings in the aforesaid case, learned counsel for the petitioners requested this Court to dispense with the appearance of the petitioners/A1 and A3 in the aforesaid case before the trial Court. 4.

Learned Additional Public Prosecutor submits that since the 1st petitioner/A1 is prime accused in the crime, his presence may not be dispensed with.

In view of the aforesaid submissions, the appearance of 2nd petitioner/A3 in C.C.No.518 of 2019 on the file of the XXII Additional Metropolitan Magistrate, Cyberabad at Medchal, is dispensed with, except on the dates whenever his presence is required by the trial Court and he shall be represented by his counsel.

With the above direction, the Criminal Petition is disposed of. 7.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
