The petitioners filed appeal before the 2nd respondent seeking cancellation of pattadar pass books and title deeds issued in favour of 4th respondent.
Now the grievance of petitioners is that neither the stay application nor the appeal is taken up for hearing. Hence, the writ petition.
Heard Ms.V.Baby Rani for petitioners and the Assistant Government Pleader for Revenue.
The right of appeal is valuable statutory remedy and the 2nd respondent, after examining the prima facie case, balance of convenience etc., by now, ought to have passed an order in the stay application filed by petitioners.
The Assistant Government Pleader submits that the 2nd respondent may be directed to dispose of the stay application filed by petitioners.
The statement is placed on record.
The 2nd respondent is directed to dispose of the stay application filed by petitioners within eight weeks from the date of receipt of a copy of this order. Even otherwise convenient, the
appellate authority considers disposing of the appeal within six months from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No order as to costs.
