HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5783 of 2018 ORDER :

The petitioners are A1 and A2 in Crime No.25 of 2018 on the file of the Guntakal II Town Police Station, Anantapur District. The crime registered is for the offences punishable under Sections 147, 148, 324, 307 r/w 149 IPC.

Petitioner No.1-A1 is the de facto complainant in Crime No.24 of 2018 of the same occurrence on 01.04.2018 at the same field in relation to the boundary dispute and possession, which crime is registered for the self-same offences.

Heard the learned counsel for petitioners and the learned Public Prosecutor and perused the bail application averments and the material on record. 4.

Four persons in this case are the injured victims. Leave about petitioner No.1 is also one of the victim. The fact that A3 to A7 were granted regular bail, while they were in judicial custody from 04.04.2018, by order in Crl.M.P.No.467 of 2018 dated 10.05.2018 passed by the learned VI Additional Sessions Judge, Anantapur at Gooty is not a ground to grant anticipatory bail to the

petitioners herein, who went unsuccessful in Dr. SSRB, J Crl. P.No.5783 of 2018 Crl.M.P.No.397 of 2018 by order dated 23.04.2018 passed by the learned VI Additional Sessions Judge, Gooty and also from the dismissal order of another Bench of this Court in Crl.P.No.5454 of 2018 dated 24.05.2018.

Having regard to the above, the petitioners are not entitled to the concession of anticipatory bail and accordingly, this Criminal Petition is dismissed. The remedy left open to the petitioners if at all is to surrender and move for regular bail application to decide on own merits.

Miscellaneous petitions pending, if any, shall stand closed.
