THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6008 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A2 seeking bail in the event of her arrest in connection with Crime No.263 of 2020 on the file of Manuguru Police Station, B.Kothagudem District, registered for the offences punishable under Section 420 of Indian Penal Code and section 5 of T.S.Protection of Depositors Financial Establishment Act, 1999. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State.

The case of the prosecution is that the defacto complainant filed the present complaint alleging that he was member of chits being run by the accused named in the FIR, since 2017, however, the accused were paid an amount of Rs.23,54,000/- and due an amount of Rs.7,50,000/-, and failed to make repayment.

As seen from the complaint, the petitioner had named nine persons who are chit members and there are five persons who were running the said business. This petitioner was initially shown as Accused No.2 in the FIR and subsequently Accused No.3 in the Remand Report of Accused Nos.1 and 2. In the Remand Report it is mentioned that Accused Nos.1 and 2 were running the chits and this petitioner being a family member assisted in running the chits.

Since the main allegations are against Accused Nos.1 and 2 and they are already been arrested, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the criminal petition is allowed and the petitioners/A2 shall be enlarged on bail in the event of her arrest, subject to the following conditions:

1) The petitioner/A2 is directed to surrender before the Station House Officer, Judicial First Class Magistrate at Nampally, Manugur, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A2 on bail, on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/A2 shall appear before the said Station House Officer on every Monday between 10.30 a.m. to 1.00 p.m. for a period of eight weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation.

3) The petitioner/A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
