O R D E R

The case of the petitioner is that he is the owner of the subject property and obtained electricity connection No.4140136683, and subsequently vide registered sale deed bearing document No.10146 of 2019, on the file of Sub Registrar Officer, Suryapet, sold the property to one Mr. Polishetty Nageshwar Rao s/o Jakab, and made application dated 20.07.2019 to the 5th respondent - Telangana State Southern Power Distribution Company, represented by its Assistant Engineer, Suryapet Rural Mandal and District, to cancel the said electricity connection, which is in his name, but no action has been taken, and hence the present writ petition.

Heard the learned counsel for the petitioner. Sri R.Vinod Reddy, learned Standing Counsel for respondents 2 to 5, on instructions, submits that the application filed by the petitioner is bereft of particulars to whom the property was sold and hence action could not be taken. He further submits that, as the person to whom the property was sold, was not made party to the writ petition, the same is not maintainable, as he would be the affected person, if the power connection is disconnected. He further submits that if the petitioner makes fresh application with necessary particulars, action will be taken in accordance with law.

Heard learned Government Pleader for Energy for respondent No.1. Having regard to the facts and circumstances of the case, without expressing any opinion on merits, writ petition is disposed of, granting liberty to the petitioner to make representation afresh to the 5th respondent with relevant particulars and documents, to whom he has sold the subject property, and on receipt of such application, the said respondent, after giving notice to both the

parties, shall pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of such application. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
