THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38259 of 2016 ORDER:

This writ petition is filed seeking to declare the inaction of the 3rd respondent in not registering the complaint, dated 18.07.2016, filed by the petitioner, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that the petitioner is the absolute owner of the property in Plot No.65 in Survey Nos.61 and 62, Sardar Vallabhai Poor Class Housing Colony, Hashmathpet Road, Trimulgherry, Secunderabad and that the property acquired vide commercial proposition and there being claims and counter claims over the petitioner and some persons have indulged in creating, fabricating documents and based on which, some suits were filed by the petitioner, which are pending in the civil Court for injunction and that petitioner lodged a complaint against the said persons to the 3rd respondent, but the said complaint was refused and thereupon, the petitioner sent the same through registered post on 18.07.2016, but the 3rd respondent has not registered the same.

Considering the grievance of the petitioner, the 3rd respondent is directed to register a case, if the complaint lodged by the petitioner, dated 18.07.2016, discloses any cognizable offence and investigate into the same and file a final report, if any. If the petitioner is aggrieved by the action of the 3rd respondent, he is at liberty to approach the superior officer of 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
