This criminal petition is filed under Section 438 Cr.P.C. by the petitioner/ A2 in Crime No.23 of 2018 of Kandukur Rural Police Station, Prakasam District, registered for the offences punishable under Sections 323 and 324 r/ w 34 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State and perused the bail application averments, F.I.R., remand report of other accused and Case Diary along with wound certificate.

A perusal of wound certificate of one Malakondaiah shows that he sustained a fracture to the right middle finger, swelling deformity with injury of laceration and finger distal phalanx. There is another injured as per the F.I.R., by name Suresh, who is the informant said to have sustained injuries to left hand and head. There is nothing to show any radiology report with fracture to the head injury. A perusal of F.I.R. further shows that the dispute is in relation to a site under the occupation, where the transformer to be affixed. However, from the manner in which the offence committed even some of the accused were arrested and released on regular bail, the petitioner does not deserve concession of anticipatory bail. However, this will not prejudice to his right to surrender and move for regular bail. 4.

Accordingly, the Criminal Petition is disposed of. 5.
