HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.9856 of 2015 ORDER:

Heard the learned counsel for petitioner and none appeared for respondents.

2. This Writ Petition is filed challenging the action of the respondents in not settling/paying the balance final due bills and EMD amount in respect of the works executed by the petitioner.

3. Though this Court has no jurisdiction to issue any direction in respect of contractual matter, the learned counsel for the petitioner submitted that the Writ Petition can be disposed of by directing the second respondent to consider the representations submitted by the petitioner on 14.05.2014 in respect of agreement Nos.1/2011-12 dated 12.07.2011 and 2/2011-12 dated 02.08.2011. The representations were received by the second respondent on 14.05.2014 and till today no order is passed on the said representations or any payment was made to the petitioner.

4. In the circumstances, this Writ Petition is disposed of directing the second respondent to consider the representations of the petitioner dated 14.05.2014 and pass appropriate orders thereon within a period of 30 days from the date of receipt of a copy of this order.
