HON'BLE SRI JUSTICE S.V. BHATT W.P. Nos.18797 AND 18824 OF 2018 COMMON ORDER:

Heard Mr. Venkata Ravi Sanker for petitioners and the learned Assistant Government Pleader for Irrigation. The prayers in the writ petitions are follows: W.P.No.18797 of 2018:

"...writ of mandamus declaring the action of the Respondents and their subordinates in trying to dispossess the petitioner from his land admeasuring Ac. 1-00 Guntas situated in Sy.

No.

103/A/A of Sadhasivunipalem Village Sathupally Mandal Khammam District by way of respondent authorities intending to extend Tummalacheruvu area under mission Kakatiya scheme without issuing any notice and without initiating any proceedings under Land Acquisition Act as illegal, arbitrary, violation of principles of natural justice and violative of Articles 14, 21 and 300A of Constitution of India and consequently direct the Respondents and their subordinates not to dispossess the petitioner from the subject lands in any manner..."

W.P.No.18824 of 2018:

"...writ of mandamus declaring the action of the Respondents and their subordinates in trying to dispossess the petitioner from her land admeasuring Ac. 0-30 Guntas situated in Sy. No. 103/A and an extent of Ac.0-30 Guntas situated in Sy. No. 103/A/A/U of Sadhasivunipalem Village, Sathupally Mandal, Khammam District by way of respondent authorities intending to extend Tummalacheruvu area under mission Kakatiya scheme without issuing any notice and without initiating any proceedings under Land Acquisition Act as illegal, arbitrary, violation of principles of natural justice and violative of Articles 14, 21 and 300A of Constitution

of India and consequently direct the Respondents and their subordinates not to dispossess the petitioner from the subject lands in any manner..."

The Assistant Government Pleader places on record the written instructions dated 04.07.2018 and submits that the writ petitions are filed on mere apprehension. The operative portion of the instructions reads thus:

"Further I submit that this department is not trying to dispossess the petitioners from their land admeasuring Ac.1-00 Guntas situated in Survey No.103/A of Sadasivunipalem (V) Sathupally (M), Khammam (Dist) (WP.No.18797 of 2018) and land admeasuring Ac.0.30 Guntas situated in Survey No.103/A and Ac.0.30 guntas situated in Survey No.103/A/A/U of Sadasivunipalem (V) Sathupally (M), Khammam (Dist) (WP No.18824 of 2018), as reported by the petitioners in their writ petitions above. It is also submitted that this department has not taken up any type of work in the above petitioners land." By placing on record, the writ petitions are disposed of. No order as to costs.
