HONOURABLE SRI JUSTICE S.V. BHATT WRIT PETITION No.22353 OF 2017 ORDER:

This writ petition is filed for the following relief: " to issue a writ of mandamus declaring the action of the 3rd respondent in issuing certificate of proceedings L.Dis.No.183/ / 2011, dated 14.06.2011 in favour of the 4th respondent without issuing any notice to the petitioner and without following any procedure under the Act, as illegal and arbitrary and consequently, set aside the same." Learned counsel for the petitioner does not press the writ prayer particularly having regard to the nature of grievance the petitioner has against certificate, dated 14.06.2011, seeks liberty to represent to respondents 2 and 3 on the legality of certificate and respondents 2 and 3 may be directed to dispose of the representation. The statement is placed on record.

The writ petition is disposed of granting the liberty as prayed for. The petitioner is given liberty to represent to respondents 2 and 3 by enclosing a copy of this order. The respondents 2 and 3 to look into the representation, afford opportunity to 4th respondent as well, and pass orders expeditiously.

Accordingly, the writ petition is disposed of. The miscellaneous petitions, if any, filed in this writ petition shall also stand dismissed. There shall be no order as to costs.
