THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6014 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused seeking bail in the event of his arrest in connection with Crime No.148/2022 on the file of Mahabubabad Town Police Station, Mahabubabad District, registered for the offences punishable under Section 353 and 307 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. 3.

The allegation against this petitioner is that he entered into an altercation with the defacto complainant, traffic head constable and made nuisance. On intervention of other police personnel also he did not stop creating nuisance and kicked one police constable and also tried to attack another with stone, for which reason, present complaint is lodged alleging that the petitioner tried to kill one of the constables and he restricted the defacto complainant and other police personnel from discharging their duties. 4.

As seen from the complaint there was an altercation between three police constables and admittedly no one was injured in the said altercation, for the said reason, the petitioner who is working as Coast Guard can be granted the relief of anticipatory bail.

Accordingly, the criminal petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of his arrest, subject to the following conditions:

1) The petitioner/Accused is directed to surrender before the Station House Officer, Mahabubabad Town Police Station, Mahabubabad District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/Accused on bail, on his executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/Accused shall appear before the said Station House Officer every day between 10.30 a.m. to 1.00 p.m. from 18.07.2022 to 23.07.2022 and thereafter as and when required, for the purpose of investigation.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
