HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 7975 of 2012 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. With the consent of the parties, the writ petition is disposed of at the admission stage itself.
The case of the petitioner is that she being a landless poor person belonging to Scheduled Caste community was assigned land to an extent of Acs.5.00 in Survey No.453/273 situated at Chabolu Village, Marripadu Mandal, Nellore District, vide D-form patta No.F.DIS.102/1401 in the year 1992, and since then, she has been in possession and enjoyment of the same and was eking out her livelihood by doing cultivation. It is stated that when one N. Peddi Reddy trespassed into her land, the petitioner is said to have made complaints to 2nd respondent and 4th respondent on 19.09.2011 and 31.10.2011 respectively seeking to conduct survey and demarcation of the land after paying the requisite fee of Rs.250/-. As there was no proper response, the petitioner again made a representation dated 08.11.2011 to the 4th respondent, but till date no action has been initiated. Questioning the inaction on the part of the respondents, the present writ petition is filed.
No counter is filed on behalf of the respondents denying the averments made in the writ petition.
Having regard to the circumstances stated above and since the main grievance of the petitioner is that her representation dated 08.11.2011 for survey and demarcation of her land has not been considered till date, the Writ Petition is disposed of, directing the 4th respondent to consider and dispose of the application of the petitioner
dated 08.11.2011, if it is made and still pending consideration, in accordance with law, after giving a notice to the petitioner, within a period of twelve (12) weeks from the date of receipt of a copy of the order. There shall be no order as to costs.
Consequently, miscellaneous petitions pending if any in the writ petition shall stand dismissed.
