THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.15770 OF 2016 ORDER:

Petitioner, who is A2 in Cr.No.197 of 2016 of Huzurnagar Police Station, Nalgonda District, registered for the offence punishable under Section 307 r/w 34 IPC filed this petition under Section 438 Cr.P.C. seeking anticipatory bail.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The case of the prosecution is that on 05-10-2016, at about 7.30 P.M., the petitioner herein, who is A2, along with other accused caused bleeding injuries on the de facto complainant and her husband. Basing on the report lodged by the de facto complainant, the Station House Officer, Huzurnagar P.S. registered a case for the above offence.

Learned counsel for the petitioner submitted that on 05-10-2016, the petitioner was not in the village and the de facto complainant intentionally implicated the petitioner. 5.

Per contra, learned Additional Public Prosecutor submitted that the investigation is in progress. He further submitted that if the petitioner is released on bail at this point of time, there is every chance of tampering with the evidence of the prosecution witnesses.

As per the allegations in the complaint, the petitioner herein along with other accused beat the de facto complainant and her husband and caused bleeding injuries. Whether the petitioner was in the village or not on the date

of incident, will come to light during the course of investigation.

Taking into consideration the nature of the offence alleged to have been committed by the petitioner and also the stage of investigation, I am of the considered view that it is not a fit case to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending, in this petition shall stand closed.
