HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37830 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to call for the records pertaining to FIR No.113 of 2016 on the file of Chengumul Police Station, Ranga Reddy District, Telangana and to declare it as illegal and arbitrary. Heard and perused the material available on record. The 3rd respondent lodged a complaint against the petitioners alleging that on 22.10.2016 the petitioners came to her office and abused her with a demand to issue a possession certificate in respect of land to an extent of Ac.1.05 gunts, in Sy.No.65 of Pudur village. Learned counsel for the petitioners submits that the petitioners are no way concerned with the allegations made in the above crime and that the 1st petitioner made an application to issue possession certificate to the subject land since he is cultivating the same since so many years, but, to his surprise, the 3rd respondent lodged the above complaint at the instigation of the 5th respondent.

The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and also the submissions of the learned counsel for the petitioners, this Court is of the view that the investigation can be completed without arresting the petitioners. Accordingly, the 4th respondent is directed to complete the investigation and file a final report in the above Crime, in accordance

with law in either way, without arresting the petitioners. The petitioners are also directed to appear before the investigating officer as and when required and cooperate with the investigation. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
