HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5797 of 2018 ORDER :

The petitioners are A6 & A7 in Crime No.12 of 2018 on the file of the Puttaparthy Police Urban Station, Ananthapur District. The crime registered is for the offences punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, amended Act 9 of 2001 (for short 'the Act').

The petitioners-A6 & A7 are the so-called owner and driver of the vehicle where the contrabond was seized of 13.900 Kg of ganja. The petitioners went unsuccessful by dismissal order in Crl.M.P.No.239 of 2018 dated 24.05.2018 passed by the learned I Additional Sessions Judge, Anantapuramu.

Heard the learned counsel for petitioners and the learned Public Prosecutor and perused the bail application averments, F.I.R. and the material on record. 4.

From perusal of the record and from the expression of the Apex Court in Satpal Singh v. State of Punjab in Crl.A. No.462 of 2018 S.L.P. (Crl) No.8184 of 2017 dated 27.03.2018, this Criminal Petition is dismissed, which is

without prejudice to the petitioners to move for regular bail after surrendering to decide on own merits. Miscellaneous petitions pending, if any, shall stand closed.
