THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.8475 of 2004 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus declaring that the office order passed by the 2nd respondent in his proceedings No. P4/30(1)/2003-KG, dt.4-122003 ordering for recovery of the amounts from the salaries of the petitioners, as illegal, unjust, contrary to law, arbitrary, in violation of principles of natural justice and in violation of Articles 14, 16 and 21 of Constitution of India.

2. When the matter is taken up for hearing, learned counsel for the petitioners submitted that the petitioners have retired from service on attaining the age of superannuation. He further submitted that no further orders are necessary as no cause of action survives in this writ petition.
