HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18774 OF 2018 ORDER :

This Writ Petition is filed challenging the proceedings of the 1st respondent dated 30.04.2018 in F.No.AICTE/AB/SOUTH/CENTRAL/PID 1-2744081, dated 30.04.2018, wherein and whereby the petitioners' institution was kept under "No Admission" category for the academic year 201819 on the recommendations of Standing Appellate Committee which reads as follows:

"Since the institute have not complied with the major deficiencies like barrier free environment including lift/ramp & occupancy certificate from the competent authority, the committee recommends "No EOA for the AY 2018-19 for the course."

Heard learned counsel for the petitioners and Sri Ramakanth Reddy, learned Standing Counsel for the 1st respondent.

Sri S.Sri Ram, learned counsel for the petitioners, who submits that they have already complied with the deficiencies pointed out in the impugned order and also explained about the deficiencies, but the same are not being taken into consideration while passing the impugned order by the 1st respondent. Sri Ramakanth Reddy, learned Standing Counsel appearing for the 1st respondent, though filed counter affidavit with several allegations against the petitioners, submits that if petitioners have complied with the deficiencies as pointed out in the impugned order, same will be taken into consideration and appropriate orders will be passed.

In view of the same, this Writ Petition is disposed of directing the 1st respondent to consider the Compliance Report submitted by the petitioners, with regard to compliance of deficiencies pointed by the Standing Appellate Committee in the impugned order and pass revised order as expeditiously as possible, preferably within a period of one week from the date of receipt of a copy of this order, by affording an opportunity of hearing for explaining the material placed by the petitioners before the 1st respondent.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
