THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.8470 of 2016 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.77 of 2015 of Tanuku Police Station, West Godavari District, registered for the offences punishable under Sections 420, 468, 471 r/w 34 I.P.C.

2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor representing the State.

3. The allegations levelled in the complaint, prima facie, reveal the commission of offences against the petitioners/A6 and A7 herein along with others. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report.

4. In the facts and circumstances of the case, the investigating agency shall proceed with the investigation. However, it shall scrupulously follow the procedure as contemplated under Section 41-A Cr.P.C before taking any coercive steps against the petitioners/A6 & A7.

5. With the above directions, the Criminal Petition is disposed of.

6. As a sequel thereto, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed.
