Singalreddy Mallemkonda Reddy v. The State Of Andhra Pradesh

HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION NO. 5488 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: "to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not allotting either 5 acres of dry agricultural land or 2 1⁄2 acres of wet land and 50 cents of homestead land to each of petitioners as per Resettlement and Rehabilitation Policy, 2005 contained in G.O.Ms.No. 58, Irrigation & Power (Projects Wing) Department dated 19.3.1980 and G.O.Ms.No. 324, Energy, Forests, Environment, Science and Technology (For.I) Department dated 01.12.1988 as arbitrary, illegal and consequently direct the respondents to allot 5 acres of available dry agricultural land to each petition in Survey No. 1557 admeasuring 15 acres situated in Gopavaram Revenue Village, Gopavaram Mandal, YSR Kadapa District, Andhra Pradesh and pass such other order or orders as this Hon'ble Court may deem fit and proper".

When the matter is taken up today, learned counsel appearing for both sides submit that the subject matter of this Writ Petition is squarely covered by the Common Order dated 6.8.2015 passed by this Court in W.P.Nos. 36389 and 36391 of 2012 and a copy of the same was placed on record along with Writ Petition material papers. The operative portion of the said order reads as under:

AVSS,J W.P.NO. 5488 OF 2017 "Therefore, respondent No. 1 is directed to consider the claim of the petitioners for grant of house site pattas as per G.O.Ms.No. 324, dated 1.12.1988, take a decision and communicate the same to the petitioners within two months from the date of receipt of a copy of this order."

Following the above order in W.P.Nos. 36389 and 36391 of 2012 and for the reasons stated therein, this Writ Petition also shall stand disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
