THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.8652 OF 2008 ORDER:
This Writ Petition is filed, under Article 226 of the Constitution of India, to direct the respondents not to take any coercive steps for demolition of newly constructed temple of Sri Sita, Rama, Lakshmana and Hanuman Idols.
Heard learned counsel for the petitioner and the learned Standing Counsel for the third respondent-temple. This Court, on 19.04.2008, while ordering Rule Nisi, directed the respondents not to demolish Sri Sita, Rama, Lakshmana and Hanuman Idols until further orders. Now, a counter-affidavit, deposed by the Executive Officer of the third respondent-temple, is filed, denying the allegation of such demolition while stating that the said idols presented by the petitioner herein have been installed three years ago and the petitioner herein has been performing Kalyanothsavam every year on the eve of Sriramanavami festival. It is further stated that the third respondent has no intention to demolish the subject temple.
The above statements made in the counter-affidavit are placed on record and, accordingly, the Writ Petition is disposed of.
As a sequel thereto, miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
