CC.No.1303/2018 Between:

K.Sambasiva Rao and 24 others ... Petitioners and B.Satya Yesu Babu

...Respondent

Counsel for the petitioners:

Mr.B.Srinarayana for Mr.M.Ravindranath Reddy Counsel for the respondent:

AGP for Services The Court made the following:

Common Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) These two Contempt Cases are filed alleging willful disobedience of Order, dated 11-09-2017, in WP.No.9551 of 2017, by the respondent.

After filing of this Contempt Case, much water has flown under the bridge. The respondent- contemnor has filed counteraffidavits seeking to justify his action, but however, later he has filed additional counter-affidavits in both these cases on 04.07.2018. When this Court was not satisfied with the contents thereof, the Contemnor has again filed two separate but identical affidavits on 11-07-2018, wherein he has stated as under: "It is respectfully submitted that, consequent on issuance of promotion to the (24) ARPCs to the rank of HCs (AR), the petitioners in the said writ petition have approached the Hon'ble High Court of A.P., by way of CC No 1303/2018 in W.P.No.29225/2017 contending that, without giving personal hearing orders were passed for promoting 24 Police Constables (AR) as Head Constables (AR).

It is respectfully submitted that, we failed to follow the directions of the Hon'ble High Court issued through the Hon'ble High Court's order dated 11.09.2017. Hence I cancelled the orders of giving promotions to 24 PCs (AR) vide Proceedings in C.No.3580/A1/2017 (D.O No.1283/2018), dated 07.07.2018 and the orders passed dated 16.12.2017 are also revoked. I further submit that, I will take further steps as per orders dated 11.09.2017 of the Hon'ble High Court in W.P.no.29255/2017."

At the hearing, Mr.B.Srinarayana, learned Counsel representing Mr.M.Ravindranath Reddy, learned Counsel for the petitioners, submitted that after revoking the orders granting promotion to certain Constables, the respondent has issued notices for personal hearing to the petitioners; that the petitioners have filed their objections and also appeared in the personal hearing; and that the final orders are yet to be passed.

In the light of the above subsequent events, the cause in these Contempt Cases does not survive for adjudication and the Contempt Cases are, accordingly, closed while accepting the unconditional apology of the respondent.

As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
