The writ petition was filed on 12.04.2007 and on 16.04.2007, this Court admitted the writ petition and WPMP.No.9849 of 2007 is directed as follows:
"Both the parties are directed to maintain statusquo with regard to the possession of the property admeasuring Ac.9-26 gts in Sy.No.181 and Ac.8-14 gts in Sy.No.182, situated at Janwada Village, Shankerpally Mandal, R.R.District, pending further orders.
However, this order will not preclude the Joint Collector, R.R.District, to dispose of main case itself i.e., Case No.F2/4162/2006, after hearing all the parties therein, in accordance with law, as expeditiously as possible -Notice."
The writ prayer deals with the order dated 25.08.2006 passed by respondent No.10/Joint Collector, pending appeal in Case No.F2/4162/2006. Neither Mr.Seetharam Chaparla nor is the Assistant Government Pleader in a position to inform the Court, the outcome of appeal pending in Case No.F2/4162/2006. Further, they request time to get instructions from respective clients.
The request is refused.
This Court is of the view that with the interim order granted on 16.04.2007, the prayer in the writ petition is substantially worked out. Liberty was granted to 10th respondent to proceed to hear and dispose of the appeal pending in Case No. F2/4162/2006.
In view of the above circumstances, the writ petition is disposed of making interim order as final order subject to further rider, if the appeal in Case No. F2/4162/2006 is not yet disposed of by 10th respondent. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
