THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.34176 of 2015 ORDER:
The grievance of the petitioner is that the police authorities are not taking any action pursuant to her complaint dated 21.05.2015 lodged against respondents 4 and 5.
In the light of the law laid down by a Constitution Bench in Lalita Kumari v. Government of U.P., it is not open to the police authorities to remain dormant upon a complaint lodged by a citizen alleging criminal activity. The police are bound to either register the F.I.R. or if reasons are made out not to do so, intimate the complainant.
The writ petition is therefore disposed of directing the third respondent to take steps in the matter in accordance with the due procedure and the law laid down by the Supreme Court in the decision afore-stated. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
