THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.6338 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by petitioner/A5 seeking to quash the proceedings in Cr.No.147 of 2019 on the file of Atmakur Police Station, Suryapet District, registered for the offences under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, against the petitioner/A5. 2.

Though the petitioner/A5 has raised several grounds to quash the aforesaid proceedings, learned counsel for the petitioner requested this Court to direct the police concerned to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1. 3.

Acceding to the request of the learned counsel for petitioner, without going into the merits of the matter, the Criminal Petition is disposed of directing the police concerned to follow the procedure under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar's case (supra). No coercive steps shall be taken against the petitioner/A5 till filing of the final report. 4.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
