THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6135 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/A5 seeking to dispense with his presence in C.C.No.28 of 2013 on the file of the Principal Special Judge for CBI Cases at Hyderabad on all the dates of hearing with an undertaking to appear when the learned Judge insists for his presence.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner are punishable under Sections 120-B read with 420, 409, 420, 468, 471 and 477-A I.P.C., and Sections 9, 11, 12 and 13(2) read with 13(1)(c) & (d) of the Prevention of Corruption Act, 1988.

4. Admittedly, in Crl.P.No.5356 of 2016, which was filed to quash the proceedings in the aforementioned C.C., interim stay was granted to the person i.e., Srinivasa Balaji, who represents the petitioner herein i.e., M/s.Lepakshi Knowledge Hub Private Limited., Hyderabad, and his presence was dispensed with. Hence, this Court is of the view that no separate order is necessary in this Criminal Petition. Therefore, the presence of the petitioner in the capacity of a Managing Director is hereby dispensed with.

5. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
