HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21894 of 2019 ORDER:
When the matter is taken up for hearing, the learned counsel appearing for the petitioners submits that the electricity service connection was given to the petitioners way back in the year 2013 and they have been regularly paying electricity consumption charges and as on today there are no dues. But, the respondents are threatening to disconnect the power supply on the ground that the petitioners have not furnished a copy of the registered Lease Deed. He further submits that the petitioners have fulfilled all the terms and conditions for supply of electricity and therefore, the respondents cannot disconnect the power supply to the petitioners' electricity service connection.
The learned Standing Counsel appearing for the respondents contends that as on today, the power supply to the petitioners' electricity service connection has not been disconnected and if the respondents intend to take any action against the power supply to the petitioners' electricity service connection, they would do so, after following the due process of law and after giving an opportunity to the petitioners.
This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that since the power supply to the petitioners' electricity service connection has not been disconnected as on today, the respondents are directed to follow the due process of law and give an opportunity to the petitioners, if they intend to take any action
against the power supply to the petitioners' electricity service connection.
With the above directions, the writ petition is disposed of. No order as to costs.
