Heard the learned counsel for the petitioners and the learned Public Prosecutor.

2. The petitioners, who are A.3 and A.4, filed the present application under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.1076/2015-2016 of Prohibition and Excise Station, Rajamahendravaram South, registered for the offence punishable Section 7 (A) read with 8 (e) of the A.P. Prohibition Amended Act, 1997.

3. A perusal of the material on record shows that at the instance of the petitioners, A.1 and A.2 were carrying 140 litres of illicit distilled liquor on Scooter at Ramachandra Mission on payment of Rs.300/- to them.

4. Having regard to the nature of allegations made, I am not inclined to grant anticipatory bail to the petitioners, but, however, the petitioners/A.3 and A.4 shall surrender themselves before concerned Court and make an application for grant of bail, after giving prior notice to learned Public Prosecutor, in which event, the same shall considered in accordance with law either on the same day or at the earliest.
