HONOURABLE JUSTICE G. SRI DEVI WRIT PETITION No. 19776 of 2003 ORDER:

The present Writ Petition is filed seeking issuance of writ of mandamus declaring the action of the respondents in not ordering the retrial benefits including gratuity, encashment of earned leave to the petitioner as on the date of retirement i.e., 31.08.2002 and interest of gratuity amount, as illegal and arbitrary and consequently, direct the respondents to pay encashment of privilege leave including the interest on gratuity amount @ 18% per annum.

At the time when the matter is taken up for hearing, learned Standing Counsel appearing for the 2nd respondent would submit that an amount of Rs.1,34,032/- has already been paid to the petitioner towards privilege leave amount and he placed on record the letter, dated 29.01.2013, issued by the petitioner acknowledging the said fact. Therefore, the cause in the writ petition has become infructuous.

In the light of the documents filed by the 2nd respondent and since the amount has already been paid by the 2nd

GSD, J Wp_19776_2003 respondent, which has also been withdrawn by the petitioner nothing survives for adjudication in this writ petition. 4.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
