THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22093 of 2019 O R D E R:

Petitioner No.2 asserts that her father-in-law purchased open plot bearing Municipal No.8-2-293/80/1/N/3 forming part of Plot No.2 in Ward No.8, Road No.14, Banjara Hills, Hyderabad; that after his death, the said property was inherited by her husband, Koka Aswani Kumar, and her mother-in-law, petitioner No.1 herein; that without having any right whatsoever in the above said plot, respondent Nos.3 and 4 obtained building permission on 14.09.2017 and are proceeding with the construction activity thereon; that the petitioners filed representation on 09.09.2019 before respondent No.2-Greater Hyderabad Municipal Corporation for cancellation of the building permission granted to respondent Nos.3 and 4 and that when no action has been taken thereon, they filed the present writ petition. Heard learned counsel for the petitioners and learned Standing Counsel for respondent No.2.

Respondent Nos.3 and 4 were granted building permission as far back as on 14.09.2017, but, the petitioners chose to approach this Court after passing of almost two years. However, inasmuch as the representation dated 09.09.2019 stated to have been filed by the petitioners is pending consideration before respondent No.2, without going into the merits of the matter, respondent No.2 is directed to consider the aforesaid representation along with the material, if any, submitted by the petitioners, and pass appropriate orders thereon, in accordance with law, that too, after issuing notice to respondent

Nos.3 and 4, within a period of two months from the date of receipt of a copy of this order.

With the above, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this Writ Petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:14.10.2019 kdl
