HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43686 of 2016 ORDER:
The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the action of the 3rd respondent in neither investigating FIR No.140 of 2016 nor arresting the accused in the said crime, pursuant to the complaint filed by the petitioner, as illegal and arbitrary, and consequently, direct the 3rd respondent to complete the investigation in the abovementioned crime.
Heard and perused the material available on record. The grievance of the petitioner is that she made a complaint before the 3rd respondent against the respondents 4 and 5, basing on which a case in Crime No.140 of 2016 was registered against the respondents 4 and 5 for the offences under Sections 509 and 506 IPC on 13.02.2016, but the police did not choose to conduct investigation. Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 3rd respondent is directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible. With the above direction, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
